Do you know what you just said? You actually have epitomized what is wrong with the ESA. The judge did not "accurately" interpret the ESA. He interpreted it the way he thinks it ought to be because the ESA is now out dated and needs to be amended.
The judge can say what he wants about interpreting the ESA "as Congress intended". The problem is the metamorphosis of the ESA is not what Congress intended nor the people who put them in office.
Your view of the system is a bit idealistic but I understand what it is you are trying to say. To state in today's times that Congress represents "the will of the people" is quite far fetched. Congress cares about Congress and who's buying them off and which votes they own. It has been many years since Congress cared anything about the will of the people.
Some will agree that the ESA needs fixing. The problem is now the environmentalists own Congress. They've bought a paid a substantial investment and have come to realize the power they wield by keeping the ESA just as it is.
The ESA is not about wolves and ranchers. It is about doing what is reasonable and feasible to make sure we don't carelessly and thoughtlessly kill off another species. It's not supposed to be about saving one animal at the expense of others or stripping Americans of their rights. That's not reasonable.

Thank you Tom for writing about this case. I am a law student interested in environmental law and found your article very interesting. I would agree with you that the real problem you have with this ruling is not the judge. The judge accurately interpreted the Endangered Species Act. Your beef is correctly placed on the ESA itself. However, you should not stop there. The judge in this case pointed out that his interpretation of the ESA was correct because it was what Congress intended. So your beef should extend to Congress as well. Of course that is not the end of it. Congress represents the will of the people on its best day and the ESA is wildly popular with the general public. So maybe you should be most upset with the public who supports the ESA.

I understand why hunters and ranchers don't support the Grey Wolf but I hope you understand why the general public does.
